Abstract:

The rush to broaden executive prerogative in the aftermath of the September 11 terrorist attacks rests on a series of traditional assumptions about the nature of executive power that no longer hold water. In particular, the conventional conception of the unitary executive as best suited to the demanding tasks of crisis government is subject to criticism.
